Dear TaxMama,

My employer failed to report the proper amount of withholding to IRS. I got a CP-2000 notice dunning me for the error.

Other than getting employer to correct problem can I sue the employer?

Dear Greg,

You could sue your employer, but why go to all that trouble and expense - when there are cheaper, more effective ways to get satisfaction? (Just encourage IRS to audit him, silly. You can't even begin to imagine the grief he'll have.)

Besides, if you have enough evidence to win in court, you have enough evidence to give IRS the correct information and credit for the withholding.

Once you've done that, you have lost nothing. So there will be nothing to win in court.

For now, just fill in Form 4852, Substitute for W-2. Attach your last paystub with the year-to-date information (or a worksheet listing all the pay checks and withholding) Explain to IRS what the problem is - and you'll be fine.
