Leaner Liens

Dear TaxMama,

In 1993 my husband had a tax lien against him for 35,582. (Original amount owed was a little over 4,000 for years 1984, 86 & 87) Also, he owned nothing at the time of the lien. That same year we had an attorney get the amount reduced to $17,000. To date, he owes 11,000 but the lien on his credit record still says $35,528. Can we get that amount changed?

We own a home now and will that affect us if we try to get the amount changed? Also, under the statutes we can say bye-bye to the back taxes next year. (or can we because of the lien?) We're going to hire your attorney friend next year for that job! The reason I ask is we are trying to refinance the house and this lien is still a problem (I have a "MENSA" fico score so we got the home without going stated income).

Tell me, what can we do? Can we get the lien amount reduced without the IRS liening our home?

Hi Honey.

Ouch!

Until you're ready to do something about the loan on the house (refinance etc.) forget about the lien. IRS won't reduce the amount showing. (Or, to get them to would cost you waaay more than it's worth.)

If the statutes are about to expire in about a year. Just wait until then. Then, call IRS and

a) Make SURE that the statutes have expired (they get extended during submissions of offers in compromise and some other instances).

b) If they have, get them to send you a written lien release. And save that piece of paper forever.

You won't even need an attorney. <g>
