Borderline Sales Taxes

Dear TaxMama:

My Company is based in Canada but we do have customers in the USA. Some of our customers are in Colorado and some are outside Colorado. Should we charge sals tax when invoicing them?

Dear Lydia,

It's good of you, as a Canadian company to ask.

This is still somewhat of a gray area.

After all, Colorado doesn't really have the capabilty of coming after you to collect sales taxes.

Most likely, your customers, who appear to be end users, will need to file 'use tax' returns, at some point, if they don't pay sales tax on the equipment.

So, it's really up to you.

  1. a) Do you want to take on the responsibility of collecting sales taxes, preparing and filing the returns and sending the money to the Sate of Colorado?

  2. b) Will doing this antagonize your customers? And you do know how the medical profession hates to pay anything they don't absolutely have to ...

  3. c) Will doing this make your customers' lives easier?
If you're not doing a high volume of sales, I'd hold off for now.

Colorado doesn't seem to be overly concerned about lost sales tax revenue. They haven't joined the states in the Streamlined Sales Tax Project, which is being designed to simplify the whole process.

I know. This is overkill. You wanted a simple 'yes' or 'no.'

But this is an ethics question, not a tax question.
