» From: Beaumont, TX Dear TaxMama: I have a ex-spouse as of 2001 that did not file her W-2 in 2000, on which I now owe $12,000. The irs has levied my residence and in process of levying my bank accounts. Please help. Justin Dear Justin, It's not clear to me why her not filing a tax return would cost you your home and bank accounts. (Incidentally, IRS does not levy residences. They put liens on them to protect their interest in your equity.) If she is your EX spouse, her name should not be on your bank accounts. If she does not own the house, she should not be on title. These are all things you should have taken care of when you got divorced. If you haven't, do it NOW. If she still owns part of the house, well, IRS has a legitimate right to levy the house. You may need to buy out her interest to remove that levy and pay part of her share of the money to IRS. (Get signed documentation on it all.) Meanwhile, contact IRS immediately and ask them to put a hold on all collections actions against your assets. File a Form 8379 - Injured Spouse Form If that doesn't work, contact the Taxpayers Advocate's Office 877-777-4778 And if that still doesn't work, get professional help. That will be cheaper than risking your home and savings. Best wishes, Eva Rosenberg Your TaxMama |
